End User License Agreement
This End User License Agreement ("EULA") is a binding agreement between you and Korbition and governs the license to use Korbition's software products: the scope of the license, what you may not do with the software, warranties, liability, confidentiality, and the general legal framework of our relationship.
Korbition's legal documents are organised so that each topic has one authoritative home:
- Privacy Policy (korbition.com/privacy.html) — authoritative for data handling, security, retention, and sub-processors.
- Terms of Service (korbition.com/terms.html) — authoritative for service delivery, availability, AI features, and product schedules.
- This EULA — authoritative for the license, warranties, liability, and general legal provisions. Each product gets its own schedule as it launches; the general sections always apply too. A schedule can be linked directly, for example
korbition.com/eula.html#rulekestra.
If these documents overlap on a topic, the authoritative document listed above governs for that topic. If you install a Korbition product from the Atlassian Marketplace, Atlassian's Marketplace Terms of Use additionally govern the billing relationship with Atlassian.
Schedule A: Rulekestra
1. Definitions
- "Product" — a software product or application provided by Korbition, as listed in the schedules to this EULA or our Terms of Service (for example, Rulekestra).
- "Customer" / "you" — the organization on whose behalf a Product is installed or used. If you install a Product on your own behalf, you are the Customer.
- "Authorized Users" — the people you permit to use the Product, such as employees or contractors acting for you. You are responsible for their use.
- "Tenant" — the connected workspace a Product is installed into (for example, your Jira site).
- "Subscription" — the paid or evaluation license period through which a Product is delivered (for Rulekestra, via Atlassian Marketplace).
2. Operator
Korbition is the trade name of a German sole proprietorship (Einzelunternehmen, operated as a side business — Nebengewerbe) owned by Helena Margjeka, Germany. The legally required provider identification (Impressum) is published at korbition.com/impressum.html and forms part of this EULA by reference. All Korbition products are offered under the Korbition name.
3. License grant
Subject to your compliance with this EULA and an active Subscription, Korbition grants you a worldwide, non-exclusive, non-transferable license to install and use each Product within the scope of that Subscription, for your internal business purposes, together with its documentation. The license begins when the Product is installed into your Tenant and lasts for the duration of the Subscription.
4. Restrictions
You may not, and may not permit others to:
- copy, modify, or create derivative works of the Product, except as needed to use it as intended;
- reverse engineer, decompile, or disassemble the Product, except to the extent applicable law expressly permits and prohibits restriction;
- resell, sublicense, lease, rent, or redistribute access to the Product, or use it to provide a service to third parties;
- use the Product beyond the scope of your Subscription, or attempt to circumvent technical limits or tenant isolation;
- use the Product to process data you do not have the right to process, or to build a competing product;
- use Korbition or product names, logos, or branding without prior written permission.
5. Customer responsibilities
- You are responsible for how you configure a Product — including the notification and export destinations it sends content to, and the rules your Authorized Users author.
- You confirm you have the rights to the data you connect to a Product and that your use complies with applicable law, including your own agreements with the platform the Product is installed into.
- Korbition products are not a backup service. You are responsible for maintaining your own backups of the data in your connected platforms.
- You are responsible for safeguarding the accounts and credentials that connect your Tenant to our services.
6. Third-party products & APIs
Our Products integrate with third-party platforms (for example Atlassian Jira, Forge, Confluence, Slack, Microsoft Teams, Google Workspace). Your use of those platforms is governed by their own terms, and Korbition does not control them.
If a third party changes, restricts, or removes an API, endpoint, or capability a Product relies on, the affected functionality may degrade or stop working. Korbition will use reasonable efforts to adapt the Product, but such third-party changes are outside our control and are not a breach of this EULA.
7. Fees & billing
Products delivered through Atlassian Marketplace are billed, renewed, and refunded by Atlassian under Atlassian's Marketplace Terms of Use; Korbition does not collect or store payment details and does not set billing mechanics for those Products. If Korbition ever offers a Product for direct sale, the applicable fees are stated in the order, and statutory consumer withdrawal and refund rights (where you are a consumer) remain unaffected by anything in this EULA.
8. Intellectual property
Korbition and its licensors retain all rights, title, and interest in the Products, including all intellectual property rights. This EULA grants a license; it does not transfer ownership. You retain all rights to your own data and content; nothing in this EULA gives Korbition rights to use your content beyond operating the Products, as described in our Privacy Policy.
9. Data protection & breach notification
Korbition's data handling is described in our Privacy Policy, which is authoritative for this topic. Korbition applies technical and organizational security measures including encryption in transit and at rest and strict tenant isolation. If Korbition becomes aware of a security incident affecting your data, we will notify affected customers without undue delay and within the timelines required by applicable law, and support coordinated disclosure.
10. Confidentiality
Each party protects the other party's non-public information (including customer configurations and any non-public product information) with at least the care it applies to its own confidential information, and uses it only to deliver and receive the Products. This obligation does not apply to information that is public through no breach, was already known, was independently developed, or must be disclosed by law or court order (with notice to the other party where legally permitted). It survives termination for as long as the information remains confidential.
11. Telemetry & service analyses
Korbition collects aggregated, non-identifying operational telemetry (execution counts, latency, error status codes) to operate, secure, and improve the Products. This telemetry does not include the content of your issues, messages, or documents, and is described in the Privacy Policy.
12. Term & termination
The license lasts as long as your Subscription remains active. You may terminate at any time by uninstalling the Product from your Tenant; Korbition may suspend or terminate a Product for material breach, giving notice and a 30-day cure period — except where suspension is necessary to respond to a security risk or unlawful use, in which case we notify you as soon as practicable. When a Product is uninstalled or a Subscription ends, tenant data is deleted as described in the Privacy Policy.
13. Warranties
Korbition warrants that each Product will substantially perform the functions described in its documentation. Beyond that, and to the maximum extent permitted by applicable law, all other warranties — express or implied — are excluded. If you are a consumer, your statutory warranty and consumer-protection rights under German law remain fully unaffected by this section and by this EULA generally.
14. Limitation of liability
Korbition is liable in accordance with statutory German law. Where liability would otherwise arise from ordinary negligence, Korbition is liable only for breach of essential contractual obligations and only up to the damage typical and foreseeable at contract formation, capped in aggregate at the fees paid for the affected Product in the current Subscription term.
This limitation does not apply to liability for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) of Korbition's legal representatives or senior executives, to injury to life, body, or health, to liability under the German Product Liability Act (Produkthaftungsgesetz), to liability arising from a guarantee given in writing, or wherever mandatory law provides otherwise. If you are a consumer, more favorable statutory rules take precedence over this section.
15. Indemnification
You indemnify Korbition against third-party claims arising from (a) the data you connect to a Product, (b) the destinations and configurations you set up, (c) your Authorized Users' use of the Product, or (d) your breach of this EULA — except to the extent the claim results from Korbition's own breach of this EULA or its negligence. Korbition will promptly notify you of any such claim and will not settle it in a way that obligates you without your consent.
16. Export compliance
You agree to comply with applicable German, European Union, and international export-control and sanctions laws in your use of the Products, and you confirm you are not barred from receiving our services under those laws.
17. Publicity
Korbition may factually list your organization's name among its customers only with your prior consent. Neither party uses the other's name, logo, or branding in marketing without permission, except where already permitted (for example, Korbition's own product listings on the Atlassian Marketplace).
18. Governing law & venue
This EULA is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for disputes between merchants (Kaufleute) and Korbition is the court at Korbition's place of business as stated in the Impressum. If you are a consumer, statutory jurisdiction rules apply instead — a consumer may also bring proceedings at their place of residence, and nothing here deprives a consumer of the protection of mandatory German law.
These documents are provided in English. Korbition will make a German version available on request; where a German version is published and mandatory consumer-protection rules require it, the German version governs for consumers.
19. Changes to this EULA
We may update this EULA from time to time. When we do, we update the "Last updated" date above and record the change in the history table below. For material changes that affect paying customers, we provide advance notice through the product or by email before the changes take effect. Continued use after changes take effect constitutes acceptance.
20. General provisions
- Severability. If any provision is invalid or unenforceable, the remaining provisions stay in force, and the invalid provision is replaced by a valid one that comes closest to its intent (§ 306 BGB).
- No waiver. Failure to enforce a provision is not a waiver of it, or of any later breach.
- Assignment. You may not assign this EULA without Korbition's written consent. Korbition may assign it in connection with a transfer of the business.
- Entire agreement. This EULA, the Terms of Service, the Privacy Policy, and any product schedule together form the entire agreement between you and Korbition regarding the Products, superseding anything else on these topics.
21. Contact
For inquiries regarding this EULA, contact [email protected] or [email protected].
These license terms apply to Rulekestra, Korbition's rule automation product for Atlassian Jira. The general sections (1–21) apply to Rulekestra as well; service-delivery terms are in the Terms of Service (Schedule A) and data handling in the Privacy Policy (Rulekestra section).
A1. License scope
The Rulekestra license is scoped to the Jira site (Tenant) it is installed into, for the number of users covered by the Subscription purchased via Atlassian Marketplace. Installing it on another site requires a separate Subscription for that site.
A2. Delivery platform
Rulekestra runs on Atlassian's Forge platform, so its runtime is hosted by Atlassian and depends on Atlassian's infrastructure and APIs. Under Section 6, degradation or outage of that platform is not a breach of this EULA, though we will use reasonable efforts to preserve and recover affected event deliveries.
A3. Acting under the author's authority
Rulekestra performs actions in Jira with the permissions of the rule author and withholds any action whose authorization cannot be established. This withholding is an intended data-protection feature, not a defect, and is not grounds for a warranty claim.
A4. AI features
Rulekestra's optional AI features follow the AI terms in the Terms of Service (§6): zero data retention, no model training, and entirely optional use.
A5. Termination
You may terminate the license at any time by uninstalling Rulekestra from your Jira site, which permanently purges all tenant data as described in the Privacy Policy (Rulekestra section).
